FirstLight Home Care Franchising, LLC. (“FirstLight”) respects the privacy of each user of the Site (“you” or “a user”). By using the Site or certain services of FirstLight locations (“Services”), you signify your acceptance of this Privacy Policy and any future changes. 

Franchisees

While we require our franchisees to adhere to the principles and practices outlined in this Privacy Policy when handling personal information, each franchisee operates as an independent business. As such, we do not control and are not responsible for the privacy practices of our franchisees. 

Your use of this Site and any issues relating to this Privacy Policy are subject to FirstLight’s then-current Terms of Use, which are located on our Site at https://www.firstlighthomecare.com/terms-of-use/.

The Information Collected and How It Is Used

Personal information means any identifying information, usually your name in combination with another identifier, such as date of birth, postal address, email address, telephone number, or government-issued identification number. Personal information does not include anonymous or aggregated data that can no longer be used to identify a specific person, even if combined with other data. The specific definition of Personal Information varies from one jurisdiction to another.

There are four  principal ways that FirstLight collects personal information directly from you: (1) when you submit a referral on the Site or a “contact us” webform; (2) when you disclose it in an inquiry into locations and Services; (3) when you subscribe to our newsletter, eNews updates or other communications; and (4) We may also collect personal information about you from our franchisees. The categories of personal information we collect are: 

• Identifiers or contact information, such as a real name, address, phone number, and email address
• Personal information categories such as a name, telephone number, business contact information
• Commercial information, such as records of purchases completed or considered, or other purchasing or consuming histories or tendencies
• Internet or other similar network activity, such as browsing history or information on a user’s interaction with a website
• Geolocation data
• Health Information
• Inferences 

Personal Information Collected Automatically

The Site receives and stores information whenever a user interacts with it. FirstLight automatically receives and records certain information, including but not limited to your IP address, location, browser type, internet service provider, cookie information, pages you have requested or visited, search queries, mobile device identification, duration of your visit to the Site, browsing history on the Site, and other details of your use of the Site. 

We may receive personal information you have provided to FirstLight franchisees.

How Personal Information Collected is Used 

We collect and process personal information for the following purposes in order to:

• Provide the Site and Services
• Ensure that the Site and Services are operational and optimized for user experience
• Enhance customer experience, including to provide customer support
• Detect, prevent and investigate fraud, illegal activities, unauthorized access to or use of our Site, security breaches or any other wrongful behavior/behavior
• Deliver content and tailored advertising, and generally market and advertise Services
• Provide you with notices regarding Services
• To administer and fulfill contests, sweepstakes or other promotions

Information Collected Using Cookies

Cookies are pieces of text that may be provided to your computer through your web browser when you access a website. Your browser stores cookies in a manner associated with each website you visit. The Site uses cookies to enable FirstLight’s servers to recognize your web browser and tell FirstLight how and when you visit the Site and otherwise use the Site through the internet. Functionality Cookies help us enhance the performance and functionality of our Site to remember your choices, setting, or preferences from one visit to the next. These are not necessary for your use. Still, certain functions or features may become unavailable if you refuse them.

Analytical/Performance Cookies collect information about your use of our Site, including which pages you visit, and whether you experience any errors. These cookies do not collect any personally identifiable information. The information collected is only used to analyze how the Site is being accessed and used in order for us to improve the Site and your experience using it.

Targeting Cookies collect information designed to customize your experience on the Site and other sites, and record information about your visit to the Site, the pages you have visited and the links you have followed, so we can recognize you as a prior visitor to tailor marketing to your interests and measure the effectiveness of our marketing strategies. This information may be shared with third parties for marketing purposes.

Disclosure of Your Information

FirstLight may use service providers to operate the Site and employ other third parties to perform work on its behalf, such as the web hosting of the Site. These parties may have access to personal information that you submit through the Site, but only for the purpose of performing their duties in connection with the Site. Additionally, FirstLight’s affiliates, Google and other third parties that you authorize FirstLight to disclose your personal information to in connection with services, or products, may have access to your personal information (including but not limited to Hireology, Wellsky, Teletrack, Carezmart, Peoplematter, Nowhiring.com, Franconnect, Mailchimp, and WP Engine Server). These parties may only use your personal information for a business purpose.

Additionally, FirstLight reserves the right to disclose personal information if required to do so by law, or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with the legal process should litigation occur concerning FirstLight or the Site; (b) protect and defend the rights or property of FirstLight, the Site, or the user of the Site; or (c) act under exigent circumstances to protect the personal safety of anyone associated with FirstLight, the Site or the public.

We may disclose information to those whom we choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal information in the same way as set out in this Privacy Policy. In the event of an insolvency, bankruptcy, or receivership, your personal information may also be transferred as a business asset.

We may share your personal information with our franchisees in relation to the operation of our business or support of their businesses or so that they can send you communications about their services. In some instances, franchisees perform services on our behalf like a vendor would, and this requires us to provide them with personal information. In some instances, however, you may independently interact with and otherwise independently provide personal information to franchisees, and in such cases, we are not responsible or liable for such franchisees’ processing of your personal information. 

Selling and Sharing of Personal Information

FirstLight may disclose your personal information  to its service providers as described in this Privacy Policy to: fulfill the reasons the information has been provided; to provide you with information, products or services; to provide you with emails and other alerts concerning news that may be of interest to you; to improve the Site; and to support our analysis, research and product development. 

To facilitate site analytics and advertising, we employ  cookies and similar tracking mechanisms on our Site as set forth in our Cookies Section in this Privacy Policy.  To the extent that such mechanisms are interpreted as a “sale” or “share” of personal information, you may opt-out by accessing the cookie settings, by clicking here or by emailing us at info@firstlighthomecare.com. 

Marketing Emails

You have the right to opt out of marketing communications we send you.  If you no longer want to receive marketing-related emails, you can opt out of receiving such marketing emails at any time by click the “unsubscribe” link at the bottom of any marketing emails or by sending us an email at info@firstlighthomecare.com.

You will continue to receive certain communications from us that are necessary for our services.  

SMS Policy

Your mobile number and opt-in consent  to SMS / texting are not shared with third parties for marketing or any other purpose.

By providing your phone number and clicking “the SMS Opt-In box”, you consent and agree to opt-in to receive text messages as set forth in your consent. Message frequency depends on the marketing offers we provide.  You may opt out of receiving text messages by texting “Stop” at the end of any message you receive, or you can opt out of these communications by contacting us at info@firstlighthomecare.com and sharing the phone number that you would like to opt out. You may also reply “Help” for help. Messaging and data rates may apply. 

We may disclose your SMS opt-in or consent status with the service providers that help us provide our messaging services, including but not limited to platform providers, phone companies, franchisees, and any other vendors who assist us in the delivery of text messages. We will not share or sell your phone number or your opt-in consent to SMS / texting with third parties for direct marketing purposes.

Your Rights

Various states have privacy laws which provide their residents with certain privacy rights with respect to their personal information. California based consumers should review the “Additional California Privacy Rights” section before continuing your use of this Site. 

Residents of Colorado, Connecticut, Montana, Oregon, Texas, Utah and Virginia (and other states) may have the right to request:

• Whether we are processing your personal information, access to that information and to receive a copy of your personal information.
• Correction of your personal information that is inaccurate.
• Deletion of your personal information.

Under the Nevada Revised Statutes Chapter 603A, we do not currently engage in the “sale” of Personal Information according to the statute’s defined meaning of a “sale.”.

Do Not Track 

We currently do not respond to browser Do Not Track (DNT) signals. 

Third Party Websites and Links

Our Site may contain links to other websites. These websites may have privacy policies different from our Privacy Policy. The Site may also contain certain social media icons or widgets such as Facebook, X (formerly known as Twitter) Instagram, LinkedIn and Youtube. Although you can view the material we have linked to, you may have to create an individual account or register to use these third-party social media sites to use interactive features. Any interaction on social media or other third-party websites is governed not by this Privacy Policy but by the terms of use and privacy policy of the particular platform.

Security

We use  data and system security measures designed to protect the security of personal information both online and offline. No data transmission over the internet, however,  is completely secure. 

Children’s Privacy

This Site is not directed or targeted to children under the age of 13, and FirstLight does not knowingly collect, maintain, or use any personal information from anyone under the age of 13. If you learn that a child under the age of 13 has provided us with Personal Information in violation of this Privacy Policy, then you may alert us at Info@firstlighthomecare.com. We will take reasonable steps to delete that information as quickly as possible.

Modification of Privacy Policy

FirstLight may amend this Privacy Policy from time to time, at its sole discretion. Use of information that is collected is subject to the Privacy Policy in effect at the time such information is used.

Additional California Privacy Rights

This policy for California Residents supplements the information contained in the Privacy Policy of FirstLight Home Care Franchising, LLC, and its subsidiaries (collectively hereinafter “FirstLight,” “we,” “us,” or “our”) and applies solely to visitors, users and others who reside in the State of California (“consumers” or “you”). FirstLight adopts this policy to comply with the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, ”CCPA”) and other California privacy laws. Any terms defined in the CCPA have the same meaning when used in this policy.

Information We Collect

FirstLight collects information that identifies, relates, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“personal information”). In particular, FirstLight has collected the following categories of personal information from consumers within the last twelve (12) months: 

Personal information does not include:

• Publicly available information from government records.
• De-identified or aggregated consumer information.
• Information excluded from the CCPA’s scope, such as:
  • Health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data;

Your Rights and Choices

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Access to Specific Information and Data Portability Rights

You have the right to request that FirstLight disclose certain information to you about its collection and use of your personal information over the past twelve (12) months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

• The categories of personal information we collected about you.
• The categories of sources for the personal information we collected about
• Our business or commercial purpose for collecting or selling that personal information.
• The categories of third parties with whom we share that personal information.
• The specific pieces of personal information we collected about you (also called a data portability request).
• If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
  1. Sales: Which would identify the personal information and categories of personal information which a third party purchased from us; and
  2. Disclosures for a business purpose: Whereby we would identify the personal information and categories of personal information which we disclosed to a third party.

Deletion Request Rights

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service providers to:

1. Complete the transaction for which we collected the personal information, provide a service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you; this would include information related to providing care.
2. Detect security incidents, protect against malicious, deceptive, fraudulent or illegal activity, or prosecute those responsible for such activities.
3. Debug products to identify and repair errors that impair existing intended functionality.
4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided by law.
5. Comply with the California Electronics Communications Privacy Act (Cal. Penal Code §1546 et. seq.).
6. Engage in public or peer-reviewed scientific, historical or statistical research in the public interest that adhere to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
7. Enable solely internal uses that are reasonably aligned with consumer expectations based upon your relationship with us.
8. Comply with a legal obligation.
9. Make other internal and lawful uses of that information that are compatible with the context in which you provided said information.

Exercising Access, Data Portability and Deletion Rights

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable request must:

• Provide sufficient information that allows us to reasonably verify that you are the person about whom we collected personal information or are an authorized representative.
• Describe your request with sufficient detail that allows us to properly understand, evaluate and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

FirstLight will endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension needed in writing. We will deliver our written response electronically or by mail, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain if applicable, any reasons for which we cannot comply with a request. For data portability requests, we will select a format to provide your personal information that is readily usable and should allow you to transmit the information from one entity to another without hinderance.

FirstLight does not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive or manifestly unfounded. If FirstLight determines that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

FirstLight will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, FirstLight will not:

• Deny you services;
• Charge you different prices or raise the rates for Services, including through the granting of discounts or other benefits, or imposing penalties;
• Provide you with a different level or quality of Services; or
• Suggest that you may receive a different price or rate for Services or a different level or quality of Services;

Solely on the basis of you exercising your rights under the CCPA.
